1. Acceptance of Terms
By accessing or using the website of Lorikeet Security Canada (lorikeetsecuritycanada.ca) or requesting cybersecurity consulting, penetration testing, or compliance readiness services, you agree to be bound by these Terms of Service and all applicable Canadian federal and provincial laws.
2. Services and Rules of Engagement
Lorikeet Security Canada provides offensive security testing, cloud security configuration reviews, network assessments, and compliance readiness consulting. All active technical assessments are conducted solely under formal, signed Statements of Work (SOW) and explicit Rules of Engagement (ROE) authorizing testing against client-owned or authorized target systems.
- Authorization: The client represents and warrants that they possess full legal title or explicit written authorization to commission testing on all designated targets.
- Care and Skill: We exercise professional commercial diligence to avoid disruption to production systems. Destructive testing techniques are only executed when explicitly requested and scoped in writing.
- Retesting: Standard penetration testing deliverables include one complimentary retesting round on identified critical and high findings within the contractually agreed window (typically 30-60 days).
3. Confidentiality and Non-Disclosure
Both parties agree to hold in strict confidence all proprietary technical information, vulnerability discoveries, network topologies, credentials, and business strategies disclosed during an engagement. Lorikeet Security Canada treats all finding reports and attestation letters as confidential client property.
4. Intellectual Property
Upon final payment for professional services, the client owns all final reports, attestation letters, and custom deliverables created specifically for the client. Lorikeet Security Canada retains all rights to its pre-existing testing methodologies, assessment tools, scripts, and general security knowledge.
5. Limitation of Liability
To the maximum extent permitted under applicable Canadian law, neither party shall be liable for indirect, incidental, special, consequential, or punitive damages. The total cumulative liability of Lorikeet Security Canada for any claim arising out of or relating to these Terms or any engagement shall be limited to the total fees paid by the client under the applicable Statement of Work in the twelve (12) months preceding the claim.
6. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta (or Ontario, as designated in the relevant client SOW) and the federal laws of Canada applicable therein, without regard to conflicts of law principles.
